Update/Supplementary Financing: Building Permission for a Small Wind Energy Turbine in Germany
Dr. Dirk Legler from the Hamburg law firm Rechtsanwaelte Guenther, who specializes in energy and environmental law, has achieved an initial legal success with the help of sponsorships via the AEQUIFIN platform and is now asking sponsors for further financial support for this reference case:
We have obtained the admission of the appeal. Although the local community mandated an experienced law professor and massively opposed it. A lot of writing had to be produced. Much more than expected. But we were successful! The municipality's preventive planning has not yet been approved by the Higher Administrative Court. Unlike the Trier Administrative Court, the top judges in Rhineland-Pfalz recognized that small wind turbines should be treated differently from large wind turbines. A distance of 1,000 m from residential buildings may be proportionate for large wind turbines, but this is disproportionate for small wind turbines that are only below 30 m high and that are only for self-consumption. We want to continue to enforce this in order to help the energy transition and climate protection to succeed. Please support us!
Around €15,500 is needed to continue the case. A sponsorship is possible from 10 € and until 28.2.2023. Thank you very much for your support!
